1. Scope

The following General Terms and Conditions (GTC) apply to all orders placed via our website. The products and services offered on this website are exclusively for consumers residing in Switzerland, Germany, and Austria (hereinafter referred to as "Customer").

A consumer is defined as a natural person who maintains a business relationship with BLKNBLOOD that cannot be attributed to either their commercial or independent professional activity. Orders in quantities exceeding typical household use may be refused without explanation.

BLKNBLOOD reserves the right to amend these Terms and Conditions at any time. The version of these Terms and Conditions in effect at the time of the order shall apply and cannot be unilaterally changed for that order. Any conflicting or deviating terms and conditions of the customer are not recognized.

3rd Prizes

The sales prices listed on BLKNBLOOD are final prices and, unless otherwise stated, include any applicable statutory charges such as advance recycling fees (ARF) or copyright levies for electronic devices. Prices are net prices in Swiss francs (CHF). As a small business, we are exempt from VAT.

Shipping is free.

Any customs duties, import or handling fees incurred when shipping to countries outside the production sites (e.g. Switzerland, Germany, Austria) are the responsibility of the customer.

Technical specifications, errors and misprints are subject to change without notice. BLKNBLOOD reserves the right to change prices at any time without prior notice. Consulting and support services are not included in the sales prices.

4. Conclusion of the contract

Orders will only be shipped after full payment has been received and provided the goods are available. If it turns out that the ordered goods cannot be delivered, or cannot be delivered in full, BLKNBLOOD is entitled to refuse or only partially accept the order. In such a case, BLKNBLOOD will inform the customer by email. If the customer's payment has already been received by BLKNBLOOD, the payment will be refunded to the customer. If no payment has yet been made, the customer will be released from the obligation to pay.

The products and prices on the website represent non-binding offers.

By placing an order, the customer submits a binding offer to purchase. An automatic order confirmation documents receipt of the order but does not constitute acceptance. The contract is concluded as soon as BLKNBLOOD confirms the order by email. Since production and delivery are handled by our external fulfillment service provider, BLKNBLOOD can only accept orders as long as materials and production capacity are available.

5. Payment options and retention of title

The customer has the payment options specified in the ordering process available.

The following payment methods are available:

• Google Pay
• Apple Pay
• PayPal

BLKNBLOOD reserves the right to exclude certain payment methods without giving reasons or to require prepayment.

6. Delivery, customs and returns

Deliveries are sent by post or courier service to the address provided by the customer in the order. If delivery is not possible or the customer refuses to accept delivery, BLKNBLOOD may, after notifying the customer by email and providing reasonable notice, terminate the contract and charge the customer for any resulting expenses.

If BLKNBLOOD's inspection reveals that the goods have no detectable defects or that the defects are not covered by the manufacturer's warranty, BLKNBLOOD may charge the customer for the expenses incurred, including return shipping and any disposal costs. BLKNBLOOD does not operate its own warehouse. Production and shipping are handled by an external production and fulfillment company with locations in the EU (e.g., Latvia, Spain) and other countries.

Customs, import and shipping conditions

Deliveries to Switzerland may be subject to customs duties, import taxes, or other charges that are not included in the purchase price . These costs are levied by the relevant authorities and must be paid by the customer upon receipt of the goods. The seller has no influence over these charges.
The seller ( BLKNBLOOD ) accepts no liability for delivery delays caused by customs clearance, government actions, force majeure, or disruptions in the international shipping network of the production and shipping service provider Printful . Force majeure includes, but is not limited to:

• Natural events such as storms, floods, volcanic eruptions, tsunamis, earthquakes, fires or other natural disasters
• Wars, armed conflicts, terrorist attacks, uprisings, strikes, epidemics, pandemics, government orders or official measures , as well as disruptions in transport, communication or energy supply networks that are outside the control of the seller or the production and shipping service provider Printful.
  

During such events, the seller's contractual obligations are suspended. If force majeure events lead to a delay of more than 30 days , both parties are entitled to withdraw from the contract. In this case, any payments already made will be refunded proportionally.

7. Right of withdrawal

Since all products are individually manufactured to order, there is no right of withdrawal or return (in accordance with Art. 16 lit. c Consumer Rights Directive analogously).

A replacement or refund is only possible in the following cases:

• damaged or defective goods
• Incorrect delivery by the producer (Printful)

In these cases, BLKNBLOOD is entitled to provide a replacement or refund the purchase price.

If a delivered item is faulty or damaged, the customer is obliged to report the defect to the seller by email within 7 days of receiving the goods .

The notice of defects must contain the following information:

• Order number
• Description of the defect as well as
• Meaningful photographic documentation of the damaged item and, if possible, the packaging.

Upon receipt of a defect notification, the seller will forward the matter to the commissioned production and shipping service provider and initiate an investigation. If the defect is confirmed by our external fulfillment service provider, the buyer may choose between a replacement delivery or a refund of the purchase price. Returning the defective goods is only necessary if our external fulfillment service provider explicitly requests it. In this case, the seller will inform the customer of the corresponding return address, which is based on the production location. Returns sent independently without prior consultation will not be accepted. The seller strives to process complaints promptly and in the customer's best interest.

8. Warranty

BLKNBLOOD strives to deliver goods of impeccable quality. BLKNBLOOD reserves the right to fulfill its warranty obligations by providing an equivalent replacement or by refunding the purchase price. Further claims (e.g., for consequential damages or lost profits) are excluded.

BLKNBLOOD cannot provide any assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, nor regarding the continuous or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website will not infringe upon the rights of third parties not owned by BLKNBLOOD.

9. Liability

BLKNBLOOD excludes all liability, regardless of its legal basis, as well as any claims for damages against BLKNBLOOD and any auxiliary persons or agents. In particular, BLKNBLOOD is not liable for indirect damages and consequential damages, lost profits, or other personal injury, property damage, or purely financial losses suffered by the customer. This exclusion of liability does not apply to mandatory statutory liability, such as for gross negligence or willful misconduct.

BLKNBLOOD uses hyperlinks solely to facilitate customer access to other websites. BLKNBLOOD has no knowledge of the specific content of these websites, nor does it assume any liability or other responsibility for their content.

10. Data protection

BLKNBLOOD may process and use the data collected during the conclusion of the contract to fulfill its obligations under the purchase agreement and for marketing purposes. Data necessary for the performance of the contract may also be passed on to commissioned service partners (logistics partners) or other third parties.

11. Partial invalidity

Should individual provisions of these terms and conditions prove to be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

12. Further provisions

BLKNBLOOD expressly reserves the right to change these terms and conditions at any time and to put them into effect without prior notice.

In the event of disputes , Swiss substantive law shall apply exclusively, excluding any conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is 8134 Adliswil or the residence of the consumer .
